NOTICE OF CONFIRMATION OF A COMPULSORY PURCHASE ORDER THE HAMPSHIRE COUNTY COUNCIL NEWGATE LANE
(Tanners Lane to Peel Common Roundabout)
COMPULSORY PURCHASE ORDER 2016

The Highways Act 1980 and the Acquisition of Land Act 1981

1. Notice is hereby given that the Secretary of State for Transport, in exercise of his powers under the above Acts, on 5 April 2016 confirmed with modifications the Hampshire County Council Newgate Lane (Tanners Lane to Peel Common Roundabout) Compulsory Purchase Order 2016 submitted by Hampshire County Council (the “Acquiring Authority”)

2. The Order as confirmed provides for the purchase of the land described in the Schedule hereto for the purpose of:
2.1 The construction of a new 1.5 kilometre section of single carriageway road between Tanners Lane and Peel Common roundabout including the link road to the existing alignment through predominantly undeveloped farmland which lies within the Meon Strategic Gap.

3. A copy of the Order as confirmed by the Secretary of State for Transport, and of the map referred to therein have been deposited at offices of the Hampshire County Council, The Castle, Winchester SO23 8UJ and at Fareham Library, Osborn Road, Fareham PO16 7EN and at Stubbington Library, Stubbington Lane, Stubbington Fareham PO14 2PP and at Gosport Discovery Centre, High Street, Gosport, Hampshire PO12 1BT and may be seen at all reasonable hours.

4. The Order as confirmed becomes operative on the date on which this notice is first published. A person aggrieved by the Order may, by application to the High Court within 6 weeks from that date, challenge its validity under Section 23 of the Acquisition of Land Act 1981. The grounds for a challenge can be that the authorisation granted by the Order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the Order.

Amenity scrub land situated to the west of Brookers Field Recreation Ground (Plot 2)
Amenity scrub / playing field verge adjoining, and situated to west of Brookers Field Recreation Ground (Plots 3 and 3a);
Arable land situated to the east of Newgate Lane (Plots 4, 4a, 4b and 4c)
Arable land situated to the east of Newgate Lane (Plots 5, 5a and 5b).
Arable / pasture land situated to the east of Newgate Lane (Plots 6, 6a, 6b and 6c).
Area of existing track at Brookers Lane (Plot 8)
